The new permitting process for construction water taking in Ontario

ABSTRACT: In 2016, the Ontario Ministry of Environment and Climate Change (MOECC) introduced new regulations and guidelines to speed up the permitting process for some construction water takings. Water regulation affects a large number of construction projects, as water is both an essential resource for construction and frequently an engineering issue. Changes in water related regulations for construction should be watched closely for potential impacts on project costs and schedules. The MOECC changes include an option to register a water taking for some construction projects on the Environmental Activity and Sector Registry (EASR) instead of obtaining a Permit To Take Water (PTTW) from the MOECC. In some cases, clarifications exempt some takings from either a PTTW or the EASR. Water taking applications made to the EASR are issued automatically, with no technical review by the MOECC or opportunity for public comment. Nevertheless, there are requirements for a Qualified Person (QP) to prepare supporting documents. This paper reviews how the new regulations will change existing practices, and discusses the possible implications for QPs operating in Ontario.

RÉSUMÉ: En 2016, le Ministère ontarien de l'Environnement et de lAction en matière de changement climatique (MOEA) a introduit de nouvelles réglementations et directives pour accélérer le processus d'autorisation de certains prélèvements d'eau pour fin de construction. La réglementation sur l'eau touche un grand nombre de projets de construction étant donné que l'eau est à la fois une ressource essentielle pour la construction et souvent un problème d'ingénierie. L'évolution de la réglementation sur l'eau pour les projets de construction doit être surveillée de près en ce qui a trait aux impacts potentiels liés aux coûts des projets et aux échéanciers. Pour certains projets de construction, les modifications comprennent option enregistrer un prélèvement d'eau au registre environnemental des activités et des secteurs (REAS) au lieu de présenter un permis de prélèvement d'eau (PPE). Dans certains cas, des clarifications exemptent certains prélèvements de l'obtention d'un PPE ou de l'enregistrement au REAS. Les demandes présentées au REAS sont délivrées automatiquement, sans examen technique par le MOEA ou opportunité pour le public de commenter. Il y a, cependant lexigence une personne qualifiée (PQ) pour préparer les pièces justificatives. Cet article examine la façon dont les nouveaux règlements vont changer les pratiques existantes et discute les implications possibles des PQ qui pratiquent en Ontario.
